  Massachusetts cares not if your ride has pedals or not. If you meet 
these terms, you are a 'moped': http://www.mass.gov/rmv/license/7moped.htm

If you have a newer scooter which is capable of more then 30 mph (which 
the newer ones pretty much all are, even the 50cc ones) then you are now 
classified as a 'limited use vehicle': http://www.mass.gov/rmv/regs/luv.htm

If you don't fit into either of the above categories, have a motor and 
have less than four wheels, you're riding a motorcycle.

Parking regulations for mopeds and limited use vehicles are set by 
individual cities and towns, so it is not explicitly illegal to park a 
'moped' at a bike rack unless you specifically know that the town you're 
in says so.
