This is an email I received from Stephen Smith of KSS Realty in response to our
recommendations from 2 months ago vis-a-vis the MaxPak development and the
Community Path.

Tonight at 7 pm there will be a Land Use subcommittee meeting of the Board of
Alderman where a third version of the proposed development covenant will be
presented. The subcommittee could also vote on proposed zoning change that is
needed for this development to proceed. There will likely not be any
opportunity for public comment but it would be good if someone from the Bike
Committee could be there to see what transpires. I may be able to go but if
someone else could also attend, that would be much better. Any volunteers?

Important points are:
-  that there is still no permanent easement for bike and ped access thru the
Site because according the zoning, access only has to be given 9 am - 5 pm and
there could still be other restrictions put on bicyclists in the future.
-  the MBTA will require KSS to remove the rails and ties before using the ROW
but KSS has not agreed to contribute anything further for the path
implementation.
-  KSS will stop using the ROW according to requirements from the City and the
MBTA but will not agree to any specific timetable.
