Ok, the update on the legal definition of the term "parade"...
There is none. Also, there are no laws, either State or Boston,
prohibiting people from holding or participating in a parade.
Whether or not CM is a parade, it doesn't matter legally. It's allowed.
Obviously if CM participants violate other laws (go through red lights,
for example) they would be subject to the penalties of that specific
regulation (normal traffic violations would mean a ticket, not arrest).
So what's the purpose of the parade permit, then? Well, you'd want one
if you wanted to have the city close streets, for example. It's more
for convenience than anything else. But there is absolutely no
requirement to get a permit.
However, if you wanted to hold a CM in a public park in Boston, that
would fall under their rules for parks. At that point you would need a
permit (which they apparently they can't deny, though they can tell you
where, when, and how you can demonstrate...).
So parade all you want! It's legal.
